Frequently asked questions about the Accessibility Enhancement Act (BFSG)

From 28 June 2025, the Accessibility Enhancement Act (BFSG) comes into force, requiring companies to make their digital offerings accessible. This law implements the EU European Accessibility Act (EAA) directive and aims to establish uniform accessibility standards across Europe.

The Accessibility Enhancement Act (BFSG) is Germany's implementation of the European Accessibility Act (EAA) and requires companies to make digital products and services accessible. The goal is to enable people with disabilities equal access to digital offerings and create uniform standards for digital accessibility across Europe.

Affected companies must ensure their websites, apps and other digital services meet requirements by 28 June 2025 . Otherwise, sanctions apply.

The BFSG affects a wide range of digital products and services used daily. These include:

  • Websites & online shops - Companies must ensure their websites are accessibly designed.
  • Mobile apps - Apps must also be easy to operate and accessible.
  • E-books & digital documents - Digital texts must be available in accessible formats.
  • Computers, smartphones & TV devices - Electronic devices must be accessible to use.
  • Banking services & payment systems - Online banking and payment systems must be accessible to all.
  • Telecommunications & streaming services - Content must be accessible, e.g. through subtitles or screen reader compatibility.

In short: All digital offerings intended for consumers must be accessible.

Not all companies are equally affected. The BFSG provides exceptions for small businesses that meet certain economic criteria.

Exempt from the obligation are companies that:
- Have fewer than ten employees
- Generate annual turnover or balance sheet total of maximum two million euros

This regulation ensures smaller companies aren't excessively burdened. Nevertheless, accessibility is an opportunity for all companies to expand their reach and offer better user experiences.

Digital accessibility requirements are based on European standard EN 301 549. This standard closely follows the international Web Content Accessibility Guidelines (WCAG) , recognised worldwide as the standard for accessible web content.

The key principles are:

Perceivable - Content must be accessible to all senses (e.g. through text alternatives for images, subtitles for videos).
Operable - Navigation must be simple, even with alternative input methods like keyboard or voice input.
Understandable - Text and content should be easily readable and comprehensible.
Robust - Content must be compatible with various technologies and assistive tools, e.g. screen readers.

Companies should familiarise themselves with these requirements early to ensure legal compliance in time.

The BFSG officially comes into force on 28 June 2025 . By this date, affected companies must ensure their digital offerings are accessibly designed. Since implementing technical adjustments - particularly for complex websites, apps or digital services - takes time, companies should start planning now. Acting early brings not only legal compliance, but also improved usability and a larger target audience.

Companies that don't meet accessibility requirements face sanctions and fines . Exact penalties are set by relevant authorities and can vary depending on violation severity. Beyond financial penalties, there's also reputational damage. Customers experiencing digital barriers might switch to competitors. Additionally, organisations or individuals could take legal action if a company doesn't comply with requirements. Therefore, it's wise to take early action and use digital accessibility as a competitive advantage .
